How the John Bolton Legal Situation Stands Apart Substantially from Additional Former President Critics

Ex-President Donald Trump has consistently shown his desire to see opponents probed, applying pressure on the DOJ to charge former FBI Director James Comey and New York Attorney General Letitia James.

"We cannot postpone any longer, it's damaging our standing and credibility," the leader stated recently in a Truth Social post.

"They impeached twice, and indicted me (5 times!)" he declared, referencing the multiple legal proceedings he faced after departing the White House in 2021 and James's civil case.

Each have since been charged, in situations that numerous specialists have stated appear to be politically motivated and challenging to succeed in legal proceedings.

But the most recent allegations against a presidential opponent, ex national security adviser John Bolton, stand apart, legal experts and ex-prosecutors assert.

"I would say, contrasting Bolton's case to James' is like equating apples to oranges," stated Mark Lesko, a former acting US attorney for the Eastern District of New York.

This Specifics of Bolton's Case

Bolton has been criminally indicted on federal charges pertaining to the supposed improper handling of sensitive materials. Since departing the White House in 2019, he has emerged as a vocal presidential opponent, going so far as to describe him "stunningly uninformed" and unsuitable for the presidency in his book.

Specialists say that while there may be political motivations to target Bolton, the procedures used to obtain an indictment and the proof gathered against him indicate a potentially stronger legal argument than the DOJ presented against Comey.

"These actions that's being claimed is both more serious and seems to have occurred over a considerable period of time," said Carissa Byrne Hessick, a professor at the University of North Carolina School of Law.

Throughout his tenure as Trump's national security adviser, and following his 2019 White House exit, prosecutors claimed that Bolton placed the nation at risk by improperly retaining and transmitting sensitive documents to family members using insecure means, including AOL. Some of the materials were marked highly classified.

The indictment alleges that at a certain time a hacker accessed to Bolton's account where files were stored and transmitted an apparent warning to cause "the largest controversy since Hillary [Clinton]'s emails were leaked".

Bolton pleaded not guilty during a hearing on Friday to 18 distinct charges of mishandling sensitive materials.

Political Motivation or a Substantial Case?

The schedule of his indictment - arriving on the heels of charges against James - has renewed questions about external influence on the justice system.

Trump once suggested Bolton should be in prison, and called him a "disreputable person". Bolton, for his part, authored a book about his experience in the Trump administration that was highly critical of the president.

"There's no question that the schedule of this charge, when paired with others, has raised doubts about the validity of these charges, and why these counts are being brought at this time," stated Jamil Jaffer, creator and executive director of the National Security Institute.

However, he continued, "if the Justice Department is capable to demonstrate the allegations stated and show the material is correctly classified, his behavior may certainly have broken the law".

Charging such a high-ranking official for mishandling classified documents is "uncommon" but not without precedent, noted Carrie Cordero, a senior fellow at the Center for a New American Security.

"Cases that involve sensitive materials present challenges to try, but they can and are brought against both low-level and senior personnel, from time to time," she explained.

Similarities to Examinations into Former President and Biden

Trump similarly faced allegations of wrongfully keeping sensitive materials at his Mar-a-Lago property in Florida and hindering their return, but that case was eventually thrown out by a court official and voided by his re-election as leader.

A special counsel also determined that ex-President Joe Biden wrongfully stored classified documents from his time as second-in-command, but did not criminally charge him.

Bolton's case shares characteristics to Trump's sensitive materials matters, said Mr Lesko, who previously held a senior security position at the DOJ.

Rigorous protocols regulate the management of sensitive materials. To secure a conviction, the government must demonstrate that Bolton knew the material he was sending was classified, and he had to knowingly transfer it to someone without authorization to receive it.

"Because of the classified nature of the material at question in this case, we lack a great deal of details about the reasons the government believes things like the diary entries and the additional material he shared by electronic message, and the reason there were classified," explained Mr Jaffer.

A More Traditional Legal Action

The procedure by which the DOJ brought this legal action will be under scrutiny, after Trump publicly posted his wish to see his political opponents prosecuted and several of those charges came to fruition.

But Mr Lesko said in Bolton's case, authorities seem to have adhered to standard procedure.

"The Bolton case and eventually the charge seemed to have observed the standard procedure including the regulations and standards within the Department of Justice," he said.

Unlike Comey's brief, concise indictment, Bolton's was a increasingly "conventional" document that "clearly sets forth the particulars concerning the circumstances and circumstances in this instance," Mr Lesko said.

"It seems fairly aligned with a series of precedents... where government officials mishandled and transmitted classified material."
